Terms of Service

1. Provider and Scope

These terms govern your use of LLMBase, a service operated by Eyloo GmbH, Im Hemchen 20, 56410 Montabaur, Germany. Additional product-specific terms, plan limits, or order details may apply where shown during signup, checkout, or inside the service.

2. Service

LLMBase provides access to AI chat, model comparison, inference APIs, and related AI tools. Some models are hosted on European infrastructure, currently including Germany, Finland, Switzerland, and the Netherlands. Proprietary models may be operated by external providers; where required, the product asks for consent before using those providers.

AI outputs can be inaccurate, incomplete, or unsuitable for a specific purpose. You are responsible for reviewing outputs before relying on them, especially for professional, legal, medical, financial, safety-critical, or public-facing use.

3. Account Use

You must provide accurate account information, keep your credentials secure, and notify us if you suspect unauthorized access. You are responsible for activity under your account unless caused by our breach of duty.

You may not misuse the service, bypass security or rate limits, interfere with the platform, violate applicable law, infringe third-party rights, or use the service to generate or distribute unlawful or harmful content.

4. Your Content

You retain rights to prompts, files, and other content you submit. You grant us the rights needed to process that content for providing, securing, and improving the service as described in our Privacy Policy and product settings.

You must ensure that content you submit is lawful and that you have the necessary rights to use it with the service.

5. Prices, Billing, and Cancellation

Paid plans, subscriptions, usage-based charges, and prepaid credits are billed according to the prices and billing terms shown at checkout or inside the account area. Taxes may apply.

Subscriptions continue until cancelled. You can manage supported subscriptions through your account, Stripe billing portal, App Store, or Google Play, depending on where you purchased.

Mandatory consumer rights, including any statutory withdrawal rights and warranty rights, remain unaffected.

6. Availability and Changes

We may update, maintain, limit, or discontinue features where this is reasonable, for example for security, legal, provider, or technical reasons. We aim to avoid unnecessary disruption and will give notice where legally required or practically appropriate.

7. Privacy and Data Processing

Information about personal-data processing, subprocessors, hosting locations, AI-provider processing, and your data protection rights is available in our Privacy Policy. Business customers can review and accept the Data Processing Agreement in the account area.

8. Liability

We are liable without limitation for intent, gross negligence, injury to life, body, or health, guarantees we expressly give, and liability under mandatory law.

For simple negligence, we are liable only for breach of essential contractual obligations; in that case, liability is limited to typical, foreseeable damage. Essential contractual obligations are duties whose fulfillment enables proper use of the service and on which you may regularly rely.

Mandatory consumer rights and statutory warranty rights remain unaffected.

9. Termination

You may stop using the service and delete your account where supported in the product. We may suspend or terminate access where necessary to protect the service, comply with law, prevent misuse, or respond to a material breach of these terms.

10. Governing Law and Dispute Resolution

German law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws of your country of residence remain unaffected.

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
